ACCEPTANCE OF TERMS
Identity Armor is a product of IdentityArmor.com and licenses services from Identity and Credit Services, Inc. ("the Company" or “Identity Armor”), which provides its services to you, subject to the following Terms of Service, which may be updated periodically without notice to you.
When using Identity Armor, you shall be subject to any guidelines or rules applicable that may be posted periodically on the Identity Armor website. You understand and agree that violation of local, state, or federal laws, or the Company's or Third Parties' established policies and procedures might result in the immediate termination of this agreement at Identity Armor's sole discretion.
Please be aware that you must be at least 18 years of age to use Identity Armor or any of its sites. Family plans may include dependents under the age of 18 but our services must be administered by their legal guardian.
DESCRIPTION OF SERVICE
Identity Armor provides public record information ("the Service") using a variety of personal information suppliers, technologies and public information databases ("Third Parties").
You hereby authorize and instruct Identity Armor to act as your agent by accessing and using any available online searchable databases on your behalf for the purpose of obtaining and gathering personal information about yourself for your use and benefit, and to request removal of your personal information from databases if you direct us. The public information that Identity Armor obtains is delivered via the Internet by a digital dashboard that contains alert flags and nationwide public record information that is obtained from Third Parties, as well as proprietary databases and derived information. Unless explicitly stated otherwise, any new features that augment or enhance the current Service -- including the release of new Identity Armor properties -- shall be subject to this Terms of Service. You hereby authorize Identity Armor to communicate with you with routine status update emails, monthly emails, alert emails, phone calls to land and mobile lines, sms text messaging, website push notifications and with information about other privacy and security products.
You understand and agree that by using this Service either you or the Third Party supplying the product to you are responsible for paying the Company its applicable rates.
You understand and agree that along with the services that Identity Armor provides, you may also receive certain communications from the Company, such as service announcements, administrative messages, and newsletters. You understand that these communications are considered a part of Identity Armor membership and you will not be able to opt-out of receiving them.
You understand and agree that in order to use this Service you must be of legal age to form a binding contract, that you are not barred from using the services that Identity Armor, including Identity Armor, provides under the local, state, and federal laws, or other applicable jurisdictions.
You also understand and agree that when using the Service you will provide true, accurate, current and complete information about yourself, and that you will maintain and update your personal information to ensure that it is true, accurate, current, and complete.
You understand and agree that if you provide any information that is untrue, inaccurate, not current, or incomplete, then Identity Armor has the right to immediately suspend or terminate your account, and refuse any and all current or future use of the Service.
You understand and agree that your yeary service subscription will not automatically renew at the end of the predetermined time period. Your monthly subscription will automatically renew each and every month on the date service was started to keep you enrolled in the Identity Armor credit monitoring service. You can cancel at anytime by following our refund/cancelation policy.
MEMBER ACCOUNT, PASSWORD, AND SECURITY
You understand and agree that you will receive account login information upon registering on the Identity Armor website. You are responsible for maintaining the confidentiality of the password and your account information, and are fully responsible for any and all activities that occur under your password or account.
You agree to notify Identity Armor immediately of any unauthorized use of your account, or any breach of security. You also agree to ensure that you will log out of your account at the end of each session.
You also understand and agree that Identity Armor or the Company is not liable for any damage or loss that results from your failure to comply with this Terms of Service.
You agree and understand that you will not use the Service to obtain information about a person other than yourself. You understand and agree that this service is for researching your own information.
You also understand and agree that if Identity Armor or the Company has reasonable grounds to suspect that you are trying to obtain information about someone other than yourself, it has the right to suspend or terminate your account, and refuse any and all current or future use of the Service.
You understand and agree that the Identity Armor provides is "AS-IS," and that Identity Armor assumes no responsibility for the timeliness, deletion, failed delivery or failure to store any information obtained or distributed via the Identity Armor website.
You understand and agree that since Identity Armor and the Company obtains data from Third Parties that the information may, or may not be, completely thorough and accurate. You shall not rely upon Identity Armor for the accuracy or completeness of information supplied in using the Service.
LIABILITY / WARRANTY
Neither Identity Armor and the Company (nor Identity Armor's data providers / Third Parties) shall be liable for any loss or injury that may arise out of the Company's acts or omissions, whether negligent or otherwise, in obtaining, distributing, compiling, collecting, interpreting, reporting, communicating or delivering the Service.
By using the Identity Armor website, you understand and agree that every business decision involves assumption of a risk, and that Identity Armor and the Company does not underwrite that risk in any manner whatsoever.
You also understand and agree that in no event shall Identity Armor be liable for any incidental, indirect or consequential damages, however arising, incurred from receipt or use of information delivered hereunder, or the unavailability thereof.
You understand and agree that this Terms of Service grants you a limited license in exchange for payment, and that you shall not reproduce, print, retransmit, republish or otherwise transfer, any information received via Identity Armor.
You also understand and agree that you are the end user of the information obtained by using this Service. You also agree that you are not accessing information via this Service on public figures, including names in the news, media personalities, political personalities, etc.
FAIR CREDIT REPORTING ACT
You understand and agree not to use the Service for consumer credit purposes, consumer insurance underwriting, pre-employment purposes, tenant screening purposes, or for other purpose(s) covered by the federal Fair Credit Reporting Act (15 U.S.C Sec. 1681 et seq.) or similar statute.
You are also provided, free of charge your tri-credit bureau credit report as required by Federal Law. These services can be reached here: https://www.annualcreditreport.com/
You understand and agree to use the Service in strict compliance with the Gramm-Leach Bliley Act (U.S.C. Title 15, Chapter 94, Section 6801 et seq.) and similar state statutes, if applicable.
Identity Armor guarantees that the information we provide is obtained from a variety of the most accurate and reliable sources ("Third Parties") available to us.
CANCELLATION AND REFUND POLICY

If you are enrolled in a Protection Program, have paid us (or a third party has paid us) all proper fees for such Protection Program, and have fully complied with the Service Terms including, without limitations the provisions of Section 6 (Your Conduct) of the Service Terms, and you nevertheless become a victim of a fraud committed or attempted using your Personal Information without authority, we will, through the provision of Insurance described below or otherwise, retain and pay for those third party professional services that are reasonably necessary in our judgment to assist you in restoring losses or recovering your lost out-of-pocket expenses caused by such fraud. Benefits provided pursuant to this guarantee cover expenses for such third parties up to a maximum of one million dollars ($1,000,000) per identity theft event, provided that:
- You notify Identity Armor and the Insurer, as applicable, within ninety (30) days of the date you know, or reasonably should have known, that someone has improperly used your Personal Information to commit an act of identity theft;
- You fully cooperate and are truthful with Identity Armor and the Insurer, as applicable, and those third parties retained to assist you, and you agree to execute any documents Identity Armor and the Insurer reasonably require;
- You fully cooperate with Identity Armor and the Insurer, as applicable, in any remediation process, including, but not limited to, providing Identity Armor and the Insurer with copies of all available investigation files from any institution, including, but not limited to, banks, credit institutions, or law enforcement agencies relating to the alleged identity theft;
- You agree that Identity Armor and the Insurer, as applicable, will not pay or be obligated for any costs or expenses other than as described in this Service Guarantee, including without limitation fees of any service providers not retained by Identity Armor or the Insurer;
- You agree that Identity Armor reserves the right to investigate any asserted Service Guarantee claim to determine its validity;
- You agree that Identity Armor is not an insurance company, is not a credit repair organization, is not a credit counseling service, and does not promise to help you improve your credit history or rating;
- You agree the maximum amount covered for third party expenses under this Service Guarantee and the Insurance per identity theft shall not exceed $1 million in the aggregate; and
- You agree that we and the Insurer, as applicable, will not make payments to you for any loss or liability you may incur.
Should a bank or other credit institution, after reasonable investigation, determine that your reported loss is not due to identity theft, we and the Insurer, as applicable, may rely on such investigation to determine that the Service Guarantee is not applicable to such loss.
THE FOREGOING SERVICE GUARANTEE STATES THE ENTIRE OBLIGATION OF IDENTITY ARMOR AND YOUR ENTIRE REMEDY FOR ANY FAILURE OR DELAY IN PERFORMING THE PROTECTION PROGRAMS. EXCEPT AS SET FORTH HEREIN, THE PROTECTION PROGRAMS AND CREDIT MONITORING PRODUCT ARE PROVIDED ON AN "AS IS" BASIS WITHOUT ANY WARRANTY WHATSOEVER. IDENTITY ARMOR HEREBY DISCLAIMS ALL OTHER WARRANTIES EXPRESS, IMPLIED, OR STATUTORY; ARISING FROM COURSE OF DEALING, USAGE, OR TRADE; AND INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR TITLE. Some jurisdictions do not allow certain limitations of warranties, so the foregoing may not apply to you.
THIS SERVICE GUARANTEE APPLIES ONLY TO THE PROTECTION PROGRAMS.
YOUR INSURANCE COVERAGE
If you are enrolled in any of Identity Armor's Protection Programs, you will be insured for certain losses should you become a victim of identity theft. You will be reimbursed for certain out-of-pocket costs and expenses in the following categories:
- Cost of Replacing Documents
- Traveling Expenses
- Loss of Income
- Stolen Handbag, Purse, or Wallet
- Childcare and /Elderly Care
- Travel Assistance
- Fraudulent Withdrawals
The Identity Armor Insurance Policy (available here) identifies the benefit limits available for the specific Protection Program for which you have subscribed. All Protection Programs are not available in all states.
The Policy will cover certain expenses that we incur on your behalf for legal costs, remediation services costs and case management services costs per Stolen Identity Event; provided, the maximum amount of such legal costs, remediation services costs and case management services costs coverage under the Service Guarantee and the Insurance shall not exceed $1 million in the aggregate per Stolen Identity Event.
Please refer to the Insurance Policy for complete terms and conditions of coverage. The master policy holder is Identity and Credit Services, Inc and the Insurance is underwritten by AIG Inc. The policy number is 7081576 (the "Insurer").
You understand and agree that termination of your membership in any of the Protection Programs, for any reason, constitutes your consent to termination of the Insurance provided to you, and no further notice of such termination will be given to you. In the event the Insurance is terminated by the Insurer, we will notify you of such termination and of any replacement Insurance.
